Public CBC reporting mandates that eligible MNEs publish key tax-related data either on a jurisdictional (CBC) or aggregated basis. These reports, submitted to the Australian Taxation Office (ATO), will be made publicly accessible via data.gov.au to help assess whether an entity’s tax payments align with its business footprint in each jurisdiction.

Entities must report group-wide figures on:

• Revenues, profits, and income taxes
• Core business activities
• International related party transactions

The disclosures may vary based on jurisdiction:

•  Australia and ‘specified jurisdictions’: Detailed, jurisdiction-level data required.       
• All other jurisdictions: Data can be disclosed either on a CBC or aggregated basis.

You must report if you meet all of the following: 

•       Were a Public CBC reporting parent in the previous period
•       Are a constitutional corporation, or a trust/partnership made up of such entities
•       Operated in Australia during the reporting period and had at least $10 million in Australian-sourced turnover
•       Are not exempt

•        Reports must be submitted electronically to the ATO within 12 months of the end of the reporting period.
•        Material errors must be corrected within 28 days of discovery.
•        Penalties apply for non-compliance.

•        Applying for extensions
•        Requesting exemptions

While registration is optional, it streamlines communication with the ATO.

For Australia and jurisdictions with international tax agreements - such as Singapore and Switzerland - reporting must be CBC. For others (e.g., Cayman Islands, Jersey), aggregated reporting is permitted.

These jurisdictions are designated under the Taxation Administration (Country by Country Reporting Jurisdictions) Determination 2024. For these jurisdictions, specific CBC disclosures are mandatory if selected for CBC-based reporting.
